VAT on Healthcare Services in the UAE: What Is Zero Rated
Short answer: VAT on healthcare services in the UAE is zero rated when a licensed provider treats the patient directly and the service is medically necessary, including preventive care. Cosmetic treatment that no doctor prescribed is charged at the standard 5%, and so is a service one provider sells to another provider, because the patient is not the customer. Zero rated still means taxable, so a VAT registered clinic files returns and recovers VAT on its costs.
Last verified: October 2026 against Article 41 of Cabinet Decision No. 52 of 2017 (Executive Regulation, as amended and published by the FTA in September 2025), FTA Public Clarification VATP016 and the FTA Taxable Person Guide. This guide explains the rules; it is not tax advice for your specific contracts.
Key Takeaways
- Healthcare services are zero rated only if a provider licensed by MOHAP or another health authority supplies them and they relate to the wellbeing of a person.
- Cosmetic treatment is standard rated at 5% unless a doctor or medical professional prescribed it to treat or prevent a medical condition.
- When a doctor, lab or hospital supplies services to another provider rather than to the patient, the FTA says the supply is standard rated.
- Medicines and medical equipment are zero rated only if they appear on the Cabinet list, or are needed to deliver a zero rated treatment.
- Zero rated supplies count toward the AED 375,000 registration threshold, and they keep your right to recover input VAT.

The Rule in One Place: Article 41
The whole question of VAT on healthcare services in the UAE comes down to one article of the VAT Executive Regulation, Article 41 of Cabinet Decision No. 52 of 2017. Most clinic owners never read it.
The article defines healthcare services as any service generally accepted in the medical profession as necessary to treat the recipient of the supply, including preventive treatment. It then sets two conditions for the zero rate. The supply must be made by a healthcare body or institution, doctor, nurse, technician, dentist or pharmacy licensed by the Ministry of Health and Prevention or another competent health authority, such as DHA, DOH, SHA or MOHAP depending on where you operate. And it must relate to the wellbeing of a human being.
Two things are carved out. Healthcare that is only incidental to a stay at a place whose main purpose is holiday accommodation or entertainment does not qualify. Nor does elective cosmetic treatment, unless a doctor or medical professional prescribed it to treat or prevent a medical condition.
VAT on Healthcare Services: Zero Rated or 5%
Here is how VAT on healthcare services plays out for what a typical clinic, pharmacy or lab sells. Check grey areas against your contracts.
| Supply | Usual VAT Treatment | Why |
|---|---|---|
| Consultation, diagnosis or treatment by a licensed provider, billed to the patient | Zero rated | Meets both Article 41 conditions |
| Preventive care such as screening or vaccination by a licensed provider | Zero rated | The definition includes preventive treatment |
| Cosmetic procedure with no medical prescription | Standard rated (5%) | Excluded as elective cosmetic treatment |
| Cosmetic procedure prescribed to treat or prevent a medical condition | Zero rated | The exclusion does not apply when prescribed |
| Doctor or lab services supplied to another hospital or clinic under contract | Standard rated (5%) | The patient is not the recipient (FTA VATP016) |
| Medicines and medical equipment on the Cabinet list | Zero rated | Named in Article 41(4) |
| Other goods used to deliver a zero rated treatment | Zero rated | Necessary for the zero rated service |
| Retail products sold on their own, not on the Cabinet list | Standard rated (5%) | Not covered by Article 41(4) |
The cosmetic line is where aesthetic and dermatology clinics get caught. The same procedure can be zero rated for one patient and standard rated for another, so the medical reason needs to be in the record before you choose the tax code on the invoice.
Who Is the Customer: Business to Business Healthcare
The FTA dealt with this in Public Clarification VATP016. Its summary is short: a supply of healthcare services may only be zero rated if the recipient of the supply is also the person who receives the treatment.
The FTA gives three examples. A doctor contracted to see a hospital’s patients is supplying the hospital, not the patients, so the doctor’s fee to the hospital is standard rated, while the hospital’s own charge to the patient is zero rated. A lab that signs its own agreement with a patient referred by a hospital supplies the patient directly, so that test is zero rated. A hospital that pays a specialist hospital to perform a procedure on its patient receives a standard rated supply, then makes a zero rated supply to the patient.
To decide who the recipient is, the FTA says to start with the contract and who is entitled to the services under it. It also says that the person who started the supply, has an interest in it or pays for it is not, on that fact alone, the recipient. That matters for visiting consultants, outsourced lab and radiology work, and staffing arrangements between group companies. If your doctors invoice the clinic rather than the patient, look at those invoices first.
Registration, Returns and Input VAT
Zero rated does not mean outside the system. The FTA Taxable Person Guide is clear that a zero rated supply is still a taxable supply in every other respect, including the right to recover VAT on the costs of making it. In practice:
- Registration: you must register if your taxable supplies and imports in the UAE passed AED 375,000 over the previous 12 months, or will pass it in the next 30 days. Zero rated treatment counts as taxable supplies for this test. Voluntary registration is possible from AED 187,500.
- Exception: a business whose supplies are only zero rated can apply to the FTA for an exception from registration under Article 16 of the Executive Regulation. It must tell the FTA within 10 business days if it makes a standard rated supply, and register if it no longer qualifies. A clinic with any cosmetic or retail sales usually will not qualify.
- Input VAT: because zero rated supplies are taxable, a registered clinic can usually recover the 5% it pays on rent, fit-out, equipment and other costs used to make them.
- Staff health insurance: the Executive Regulation lists health insurance provided to employees and their eligible family members as an exception to the block on recovering VAT on employee benefits.
On the VAT return, zero rated healthcare goes in Box 4 (zero rated supplies). The FTA’s VAT returns user guide tells you to keep it out of the standard rated boxes.
Common Mistakes We See in Clinic Books
None of these come from a regulator list. They are the VAT on healthcare services errors we find when we take over the books of a clinic or medical centre.
- One tax code for everything. The practice system bills every item at zero, including skincare products and non-prescribed aesthetics.
- Doctor contracts that do not match the invoicing. The contract says the doctor serves the clinic, but the doctor’s invoices to the clinic carry no VAT.
- Not registering because “healthcare is zero rated”. The registration threshold test still applies.
- Not claiming input VAT on setup costs because the owner assumed a zero rated business cannot recover anything.
- No record of the medical reason for a cosmetic procedure that was billed at zero.
Frequently Asked Questions.
Is VAT charged on doctor consultations in the UAE?
Not when a licensed doctor or facility treats the patient directly. The consultation is a healthcare service under Article 41 and is zero rated, so the patient pays no VAT. If the doctor bills a hospital for seeing its patients, that fee to the hospital is standard rated at 5%.
Do aesthetic and cosmetic clinics charge VAT?
Yes, on elective cosmetic treatment. It is standard rated at 5% unless a doctor or medical professional prescribed it to treat or prevent a medical condition, in which case it can be zero rated. Keep the medical reason in the patient record.
Does a clinic need to register for VAT if all its services are zero rated?
Zero rated supplies count toward the AED 375,000 mandatory threshold, so most clinics that pass it must register. A business with only zero rated supplies can apply to the FTA for an exception from registration, but it loses that exception once it makes a standard rated supply.
Is VAT charged on medicines in the UAE?
Medicines and medical equipment listed in a Cabinet decision are zero rated, and goods needed to deliver a zero rated treatment are zero rated too. Products that are not on the list and are sold on their own, such as general retail items in a pharmacy, are standard rated.
